Legal
Terms & Conditions
These terms apply to website design, development, hosting and ongoing care work undertaken by Vesper Studio. Anything specific to your project — scope, price and timeline — is set out in your written proposal, which takes precedence over this page where the two differ.
Quotes and scope
Every project begins with a written proposal covering scope, timeline and price. Work outside that scope is quoted separately and only begins once you approve it in writing.
Payment
Unless your proposal says otherwise, a deposit is payable before work begins and the balance is payable prior to launch. Ongoing hosting and care is billed on a recurring basis and can be cancelled with reasonable notice.
Your responsibilities
You agree to supply content, images, approvals and feedback in a timely manner, and confirm you hold the rights to any material you provide to us. Delays in supplying material may shift the project timeline.
Timelines
Most websites launch in around two weeks once content and feedback are supplied on schedule. Larger or more complex projects take longer, and we will always tell you upfront.
Ownership
On final payment, you own the design and content of your website. Vesper Studio retains ownership of any underlying tooling, components and systems we reuse across projects, and may show the finished work in our portfolio unless you ask us not to.
Hosting and care
Managed hosting includes updates, backups, monitoring and ongoing support. We aim for continuous availability but cannot guarantee uninterrupted service, as parts of it depend on third-party infrastructure.
Liability
Nothing in these terms excludes rights you have under Australian Consumer Law. To the extent permitted by law, our liability for any claim is limited to the fees paid for the work the claim relates to.
Governing law
These terms are governed by the laws of New South Wales, Australia.
